About this skill

Problem

The hardest part of drafting employment-related contracts is often not wording, but correctly characterizing the working relationship. Delivering work may create a labor relationship, civil service arrangement, outsourcing scope, internship, or post-retirement engagement. If the classification is wrong, clauses such as probation, social insurance, non-compete compensation, or injury liability can become misleading.

This skill handles mainland China employment-related contracts, including employment contracts, labor service agreements, labor dispatch contracts, outsourcing agreements, internship agreements, part-time employment contracts, post-retirement engagement agreements, apprenticeship or training agreements, confidentiality agreements, and non-compete agreements. It supports two workflows: generation, where required fields are collected and missing values are marked as [to be filled]; and review, where an existing contract is checked across subject eligibility, mandatory clauses, legality, fairness, and risk clauses.

The skill first identifies the contract type, then gathers required inputs, and finally applies a type-specific workflow. Type detection considers subordinate management, worker identity, working hours, contract purpose, and special scenarios. For example, full-time work with management control usually points to a labor relationship, while student internships should not be forced into a standard employment contract template. In generation mode, it validates fields such as probation length, wage ratios, dispatch term, part-time hour limits, and non-compete compensation. In review mode, it uses the referenced legal materials to produce a structured Markdown report with severity levels: Severe, Important, and General.

Boundaries

The output is intended as a drafting aid and review checklist, not formal legal advice. Cross-border employment, multi-entity groups, equity incentives, labor disputes, or heavily regulated industries should be confirmed by qualified legal counsel.

Use Cases

  • HR teams drafting initial employment contracts and needing standard text with missing fields clearly marked.
  • Legal teams reviewing vendor agreements and deciding whether dispatch, outsourcing, or service terms apply.
  • Startups hiring interns and needing an internship agreement with school, role, stipend, and insurance fields.
  • Paralegals reviewing non-compete clauses for compensation, term limits, and eligible employee scope.

Best For

  • SME HR managers who need quick contract drafts and missing-field checks for onboarding and internships.
  • Legal counsel who need internal compliance notes on labor, dispatch, outsourcing, and non-compete risks.
  • Startup operators who need to distinguish service, part-time, and employment relationships before drafting.
  • Paralegals who need clause-by-clause review reports with severity levels and suggested fixes.
