Trademark Infringement Analysis

Problem

Trademark infringement reviews often stall on incomplete facts, weak statutory citations, and conclusion jumping. This skill supports agent-style case analysis, quick client consultations, and registration searches, using China's Trademark Law, implementation rules, CNIPA guidance, and examination materials to break down whether an act is use of a trademark, whether it is licensed, whether goods or services are similar, whether marks are identical or similar, and whether confusion is likely.

How It Works

• Five-step workflow: checks trademark use, licensing, similarity, mark similarity, and confusion likelihood, pausing at CHECKPOINT steps.
• Traceable citations: each legal basis must name the source document and article, e.g. Article 72(2) of the Trademark Law; searches can use local references/ and the ima knowledge base.
• Boundary handling: stops when blocking fields are missing, allows labeled assumptions for optional gaps, and returns None when required law, cases, or facts are unavailable.

Limits
