The problem it solves

When a client wants to challenge an issued patent, the first task is not writing a petition, but proving that the grant was unsupported. patent-invalidation addresses that workflow by turning invalidity analysis, evidence retrieval, legal-ground selection, and petition drafting into a structured process.

How it works

• Patent deconstruction: it parses the claim tree, specification, drawings, filing date, priority date, and applicant profile, then checks dependent claims, specification support, and file-wrapper estoppel issues.
• Evidence search and fixation: it uses PatSeek as the primary engine, with Boolean queries for domestic literature and semantic search for foreign literature. It can also retrieve official full-text PDFs and drawings from CNIPA, Google Patents, or Espacenet. Without an API key, it can produce an offline manual search checklist.
• Legal strategy and drafting: it maps claim features to prior-art disclosures, supports combinations of novelty, inventive step, sufficient disclosure, clarity, support, amendment beyond scope, missing essential features, double patenting, and subject matter eligibility, and helps generate feature-comparison tables, same-color figure annotations, evidence lists, and petition drafts.
• Procedural checkpoints: it reminds the user about the one-month window for adding grounds or evidence, oral-hearing preparation, deletion-style amendments, and rejection risk when the same or substantially similar grounds and evidence have already been used.

Limits and cautions

This skill is for attacking an issued patent, not for drafting new applications, responding to substantive examination, re-examination appeals, patentee-side invalidity defense, trademark or copyright invalidity. Evidence dates must predate the filing or priority date; foreign evidence needs notarization, apostille, or consular authentication, and translations should be formal. If official drawings are unavailable, user-uploaded images or SVG reconstructions may be used, but the source must be clearly labeled.
