About this skill

Problem

Employers handling terminations often need to reason about compensation standards, local labor rules, procedural risk, and negotiation scripts at the same time. Common mistakes include mixing N+1 and 2N, leaving bonuses or overtime pay out of the salary base, miscalculating unused annual leave, treating protected employees as freely terminable, and drafting agreement language that creates later disputes.

How It Works

The skill structures the input first: termination type, start and end dates, average monthly salary over the prior 12 months, work location, and flags for pregnancy/maternity/lactation, work injury, medical period, and unused leave. It then produces:
- Statutory calculations for N+1, 2N, contract non-renewal, and related bases.
- Negotiation options with lower, median, and upper ranges plus leverage analysis.
- Risk checks tagged as violation, warning, or note, covering procedural defects, weak evidence, and non-compete exposure.
- Scripts and agreement terms for negotiated termination, layoffs, and disciplinary termination.

Boundaries

It is intended for ordinary employment relationships within China and can process one employee or a batch of tabular records. It does not replace legal counsel, and it does not cover overseas employees, civil servants, public institutions, military civilian roles, collective labor disputes, or a final determination of serious misconduct. Output is Markdown, suitable for copying into spreadsheets or exporting as CSV.

Use Cases

  • HR computes N+1/2N from tenure, pay, location.
  • HR prepares layoff talks, ranges, risk checks.
  • HR drafts separation agreement clauses.
  • HR flags protected cases and writes scripts.

Best For

  • Enterprise HR: needs compensation floors and negotiable ranges before exit talks.
  • HRBP: needs compliant handling of protected employee cases.
  • Legal or compliance: needs to review agreement clauses and evidence lists.
  • Managers: needs consistent messaging and risk control in group exits.
