About this skill
What Problem It Solves
In litigation, pending cases may lack clear precedents or require checking how similar disputes have been resolved. Similar-case retrieval is not just searching for comparable judgments; it is a structured process around basic facts, legal issues, and rules of law used to support or challenge a proposed legal position. This skill turns vague requests such as “find similar cases” into an executable workflow: define the research question, choose platforms, build keywords, screen candidates, verify validity, rank results, and produce a defensible report.
How the Skill Works
- Preparation: review complaints, answers, evidence, transcripts, and prior judgments, then define the legal question, jurisdiction, court level, time range, and cause of action.
- Keywording and search paths: extract terms from facts, disputed issues, statutes, and legal doctrines; apply synonyms, hypernyms, hyponyms, and Boolean logic such as
AND,OR, andNOT; extend results through statutory associations, cited cases, judge history, and related matters. - Platforms and screening: distinguish official and commercial databases, prioritize guiding cases, cases from the official case library, gazette cases, and superior-court decisions; verify effective status, reversal risk, and potentially unfavorable language.
- Ranking and reporting: order cases by binding or persuasive authority, recency, similarity, jurisdiction, and procedural stage, then produce a report with search scope, conclusion, case summaries, comparative analysis, and supporting documents.
- Application: the focus is not blind imitation, but comparing factual differences, legal reasoning, and case holdings to decide whether to cite, distinguish, or rely partially on the precedent.
Limits and Caveats
It is most useful for novel cases, disputed legal applications, matters referred for professional judge meetings or adjudication committees, and situations where parties cite similar cases. It depends on access to external databases and official sources, and it does not replace manual verification of full judgments, current statutes, and jurisdiction-specific rules. For high-stakes or complex matters, conclusions should still be reviewed against the latest judicial interpretations and applicable court requirements.
Use Cases
- Search superior-court effective cases on liquidated damages adjustments in new contract disputes and prepare a retrieval report.
- Before trial, map the pending case's disputed issues and verify guiding or library cases supporting our legal position.
- Prepare a table-based case comparison and trend conclusion for a client on late payment and termination in construction contracts.
- For appeals or retrials, trace follow-up proceedings, reversal risks, and local precedent standards for similar cases.
Best For
- Litigation lawyers handling contract or construction disputes: need to convert disputed issues into keywords and verify citable cases.
- Legal researchers or case-library maintainers: need to screen guiding and library cases and produce a report for submission.
- Law clerks preparing trial materials or client updates: need to summarize holdings, reasoning, and comparison tables.
- Court researchers studying adjudication standards: need to compare statutory application across jurisdictions, court levels, and time periods.
